การจ้างงานคอมมิชชั่น (รูปวาด) นั้น จะถือว่าผู้ว่าจ้างได้ยอมรับเงื่อนไขและข้อตกลงการให้บริการโดยอัตโนมัติ

ไม่อนุญาตให้นำผลงานคอมมิชชั่นไปใช้เพื่อวัตถุประสงค์ที่ข้องเกี่ยวกับ AI รวมถึงการอัพโหลดผลงานเข้าเว็บไซต์ดังกล่าว

ไม่อนุญาตให้นำผลงานคอมมิชชั่นไปใช้/เกี่ยวข้องกับ NFT โดยเด็ดขาด

หากมีข้อสงสัยเพิ่มเติมสามารถติดต่อได้ทาง อีเมล หรือ โซเชียลมีเดียอื่นๆ

ผู้ว่าจ้างจะต้องอ่านเงื่อนไขและข้อตกลงการให้บริการ รวมถึงเรทราคาคอมมิชชั่นแล้ว

ผู้ว่าจ้างสามารถนำผลงานที่จ้างไปโพสต์ได้ ตราบใดที่ให้เครดิตกลับมาที่ผู้วาด (hanauchuu)

ไม่อนุญาตให้นำผลงานไปดัดแปลง แก้ไข หรือนำไปใช้ผิดจากวัตถุประสงค์ที่ตกลงกันไว้ โดยรวมถึงการนำภาพไปอ้างอิงหรือวาดตาม (เช่น นำไปใช้เป็นเบส)

ผู้วาดยังมีสิทธิ์ในผลงานที่สร้างสรรค์ขึ้นมา รวมไปถึงการนำไปโพสต์ตามสื่อต่างๆ เพื่อประชาสัมพันธ์ตนเอง หรือวัตถุประสงค์อื่นตามที่ได้ตกลงกันไว้

ขอสงวนสิทธิ์ในการลงลายเซ็นต์ และ/หรือ ลายน้ำลงในผลงาน

ราคาที่ระบุไว้เป็นราคาเริ่มต้น และสามารถเปลี่ยนแปลงได้ขึ้นอยู่กับความต้องการของผู้ว่าจ้าง สามารถอ่านรายละเอียดเพิ่มได้ใน การนำไปใช้ในเชิงพาณิชย์

ผู้ว่าจ้างรับทราบว่าชิ้นงานที่ได้รับจากการคอมมิชชั่นเป็น “ผลงานดิจิตัล” และเป็นทรัพย์สินทางปัญญาจากผู้วาด

ไฟล์ที่จะได้รับอยู่ที่ขั้นต่ำ 4x6 นิ้ว 350 DPI และไม่เกิน A4 350 DPI โดยจะส่งไฟล์ให้ผู้ว่าจ้างเป็นไฟล์ .png และ .psd รวมเลเยอร์เป็นบางกรณี

ผู้ว่าจ้างจำเป็นจะต้องบันทึกไฟล์ รวมถึงข้อมูลอื่นๆ ที่ส่งให้เมื่อเสร็จสิ้นแล้ว

ผู้วาดจะเก็บผลงานไว้ให้เป็นระยะเวลา 3 เดือนนับจากวันที่เสร็จสิ้น ทั้งนี้ ไม่รวมถึงกรณีเกิดอุบัติเหตุหรืออุปกรณ์การทำงานพังจนไม่สามารถกู้ไฟล์ให้ได้

หากผู้ว่าจ้างต้องการนำผลงานไปใช้ในเชิงพาณิชย์ ราคาสุทธิของคอมมิชชั่นจะถูกปรับขึ้นและแจ้งให้ทราบก่อนการยืนยันว่าจ้าง

ผู้ว่าจ้างต้องแจ้งให้ทราบให้เรียบร้อยภายในช่วงยืนยันการว่าจ้าง

ราคาจะเพิ่มขึ้น ขั้นต่ำ 50% จากราคาเริ่มต้น โดยจะเปลี่ยนแปลงขึ้นอยู่กับวัตถุประสงค์การใช้งาน

การนำผลงานไปใช้ในเชิงพาณิชย์นั้นครอบคลุมการใช้งานดังนี้: การนำผลงานคอมมิชชั่นไปผลิตซ้ำ และ/หรือ ขาย รวมถึงการใช้เพื่อประชาสัมพันธ์ที่ก่อให้เกิดรายได้ (เช่น แอสเซ็ทหรือรูปโปรโมทสำหรับ Vtuber, ปกนิยาย, ภาพประกอบเพื่อประชาสัมพันธ์ให้แบรนด์หรือองค์กร ฯลฯ)

การจองคอมมิชชั่นสามารถทำได้ผ่านทาง Vgen (หรือแพลตฟอร์มอื่นที่ได้แจ้งไว้) โดยจะแจ้งกำหนดการล่วงหน้าก่อน

ผู้ว่าจ้างจะต้องส่งรายละเอียดคอมมิชชั่นผ่านทางฟอร์มภายในเวลาที่ตกลงกันไว้

เพื่อให้ผลงานที่ออกมามีความถูกต้องมากที่สุด ขอให้เขียนรายละเอียดมาให้กระชับและครบถ้วน และ/หรือ มีภาพอ้างอิงที่ชัดเจน

หากเป็นไปได้ ขอให้หลีกเลี่ยงการนำผลงานของนักวาดคนอื่นมาเป็นภาพอ้างอิง

ผู้วาดจะติดต่อผู้ว่าจ้าง รวมถึงสอบถามเกี่ยวกับรายละเอียดคอมมิชชั่น (ถ้ามี) เพื่อยืนยันการจ้างงาน

สงวนสิทธิ์ในการปฏิเสธงานหากเห็นว่าไม่สามารถทำให้ได้

ผู้วาดจะตอบกลับข้อซักถามเกี่ยวกับคอมมิชชั่นภายใน 3 วัน

ผลงานคอมมิชชั่นจะแล้วเสร็จภายใน 60~90 วัน หรือตามแต่ตกลงกับผู้ว่าจ้าง

ผู้ว่าจ้างมีสิทธิ์จะกำหนดวันส่งผลงานได้ โดยจะต้องแจ้งให้ทราบภายในระยะเวลายืนยันการว่าจ้างคอมมิชั่น

ผู้วาดจะไม่รับผิดชอบหากผลงานไม่เสร็จตามกำหนด ในกรณีที่ไม่สามารถติดต่อผู้ว่าจ้างตามกรอบเวลาได้ทัน

ไม่มีการเร่งงานหลังจากตกลงเวลาส่งผลงานแล้ว หากยังอยู่ในเวลาที่กำหนด

ผู้วาดมีสิทธิ์จะทำงานคอมมิชชั่นชิ้นอื่นไปพร้อมกัน ตราบใดที่ยังไม่เลยกำหนดเวลาที่ตกลงกับทางผู้ว่าจ้างไว้

ผู้วาดจะแจ้งล่วงหน้าหากมีความจำเป็นจะต้องส่งงานล่าช้าทุกครั้ง

ผู้วาดจะส่ง WIP (ภาพระหว่างการทำงาน) ให้ผู้ว่าจ้างตรวจ โดยจะส่งเป็นภาพไฟล์ .jpg หรือ .png แนบผ่านอีเมล หรือช่องทางอื่นตามแต่ตกลง

ผู้ว่าจ้างจำเป็นต้องตอบรับ WIP ทุกครั้งไม่ว่าจะมีการแก้ไขหรือไม่ และเป็นความรับผิดชอบของผู้ว่าจ้างที่จะต้องตรวจทานรายละเอียดของผลงานร่วมด้วย

ผู้ว่าจ้างสามารถขอให้แก้ไขผลงานคอมมิชชชั่นได้ 3 (สาม) ครั้งในขั้นตอนสเก็ตช์งาน และสามารถแก้ไขได้หลังจากนั้นเพียงเล็กน้อยหลังจากยืนยันสเก็ตช์แล้ว

ในกรณีที่ขอแก้ไขมากกว่าที่กำหนดจะมีการเรียกเก็บค่าแก้เพิ่ม โดยจำนวนเงินจะขึ้นอยู่กับรายละเอียดที่ต้องการให้แก้ไข

หลังจากทำงานเสร็จสิ้นแล้ว จะแก้ไขผลงานให้ในกรณีที่ผู้วาดเป็นคนทำพลาดเท่านั้น (เช่น ผู้วาดตกหล่นรายละเอียดที่ระบุไว้แล้ว เป็นต้น)

ชำระเงินหลังจากผ่านขั้นตอนส่งใบเสนอราคา โดยจะเรียกเก็บมัดจำหรือชำระเต็มจำนวน อาจมีการเปลี่ยนแปลงขึ้นอยู่กับข้อตกลงกับผู้ว่าจ้าง

ชำระเงินผ่านช่องทางของ Vgen โดยคิดเรทจากไทย>ดอลลาร์สหรัฐตามค่าเงินช่วงนั้น

กรณีเปิดคอมมิชชั่นผ่านช่องทางอื่น จะชำระเงินผ่านบัญชีธนาคารสำหรับลูกค้าในประเทศไทย (ธนาคารกสิกรไทย)

ผู้ว่าจ้างรับทราบว่าชิ้นงานที่ได้รับจากการคอมมิชชั่นเป็น “ผลงานดิจิตัล” และเป็นทรัพย์สินทางปัญญาจากผู้วาด

ผู้วาดจะทำงานต่อหลังจากได้รับเงินเต็มจำนวน เว้นแต่จะมีการตกลงกับผู้ว่าจ้างไว้ก่อน

หากผู้ว่าจ้างไม่ชำระเงินภายในเวลาที่แจ้งไว้จะถือว่าการว่าจ้างนั้นๆ ถูกยกเลิกโดยอัตโนมัติ

หากมีความจำเป็นจะต้องยกเลิกงาน จำเป็นจะต้องแจ้งผู้วาดทุกครั้ง

ขอสงวนสิทธิ์ในการยกเลิกการทำงาน หากพบว่าผู้ว่าจ้างมีพฤติกรรมที่ไม่เหมาะสม และ/หรือ ไม่สามารถติดต่อสื่อสารได้

ผู้วาดจะคืนเงินในกรณีที่เห็นว่าไม่สามารถทำงานต่อให้ได้เท่านั้น เหตุผลอื่น (เช่น เกิดเปลี่ยนใจไม่รับผลงานแล้ว) จะไม่รวมอยู่ในนี้

ไม่มีการคืนเงินให้ในกรณีต้องการปฏิเสธการชำระเงิน

หากพบว่าผู้ว่าจ้างจงใจไม่ชำระเงิน หรือจงใจไม่ติดต่อ จะถูกแบล็คลิสต์โดยอัตโนมัติ

You, the Client, will be expected to first read my ToS and understand my general Commission Prices.

You may display my work on external sites as long as it is visibly credited and/or linked back to me (hanauchuu).

You are NOT authorized to change, modify, edit or use my works in any way without my permission, including the use of the artwork as a “base.”

I retain all copyright over my work, which includes the right to redistribute, reproduce, or use the image as a sample for sales or self-promotion unless otherwise agreed upon.

I reserve the right to sign and/or watermark my own work.

Prices listed are starting prices, and prices are subject to change according to customer requirements. See Commercial Usage Agreement for more information.

Please note that all of my sales are "Digital Artwork" and it is the Artwork’s "Intellectual Property" that is purchased by you, the Client.

Commission file(s) size will be set at minimum resolution of 4x6 in, 350 DPI, and maximum resolution of A4, 350 DPI. All files will sent in .png files, and merged .psd files as optional.

You, the Client, are responsible for saving any information, images, and other digital data I provide.

Any file you paid for will be available from me for a finite time only. I take measures to preserve most files for up to 3 months. However, I cannot guarantee against computer failure or accidental deletion or loss.

If you, the Client, wish to order a commission for Commercial use, the total price of the commission, as well as any other royalties, will be agreed upon upfront.

Commercial usage must be disclosed prior to slot confirmation.

The minimum price increase 50% of the original price, meaning increase your end sum by an additional half. However, I reserve the right to charge more if I deem fit.

The following cases are considered commercial use: Reproducing and selling the artwork, publicly or privately, cases where you receive profit from a medium/platform where you have posted my artwork, (e.g., YouTube, Vtuber assets, digital/physical novel cover, a personal site, business cards, etc.).

Commission request will be accepted through Vgen (or other platform informed) with notice in advance.

You are expected to fill out the commission request form within the time agreed.

To guarantee the total accuracy of your commission request, please make your request concisely worded with minimal abbreviations and/or have visibly clear reference images.

Please refrain from using other artist's work as style reference.

You will then get a reply from me discussing the details (if needed) as well as me confirming your slot.

I reserve the right to decline any project or client for any reason.

I usually take up to 3 days to respond to your initial order inquiry.

For completion, commission will be completed within 60~90 days unless agreed otherwise.

You reserve the right to set a deadline for your commission. This deadline must be disclosed prior to slot confirmation.

If due dates are discussed, it is also the clients' responsibility to ensure prompt communication. I will not be held responsible for late delivery.

No harassment over my work speed will be tolerated, regardless of the time that has passed.

With the deadline that has been discussed, I will work on the piece I'm the most inspired/ comfortable with at the moment.

You reserve the right to be notified of any delays.

I will send a WIP (‘work in progress’) image within the date discussed with the client. These images will come in the form of .jpg or .png files as an attachment in the email or other platform agreed.

Each time I send a WIP to a client, I ask the client to provide feedback to me. The responsibility is on you to ensure your order contains the details you want me to follow.

Up to 3 (three) major revisions can be made during the sketching phase of the commission. Only minor adjustments within reason can be made afterwards.

Any changes to the character or subject after that will be subject to a fee, and the fee will depend on the nature of the change.

After the order is completed, minor changes such as color adjustments are allowed if the missing or inaccurate elements are my faults (e.g., I overlooked details provided in the order).

Payment will be requested after commission proposal confirmation process has been made. This can be changed upon agreement with the client.

For international client, I will only accept via Vgen platform as payment. You are responsible for making currency conversions.

Please note that all of my sales are "Digital Artwork" and it is the Artwork’s "Intellectual Property" that is purchased by you, the Client.

It is expected that you deposit 100% of the price upfront before I resume the process. No exceptions unless otherwise discussed.

If payment is not made in a timely manner (48 hours) after I've placed the Invoice, the commission will be cancelled.

You are required to contact me when you need to cancel a commission request.

I reserved the rights to cancel commission due to client’s inappropriate behavior and/or poor communication.

Refund only be made in case that I cannot proceed the commission for any reason. Other reasons will not be considered as refund (e.g., disliking commission).

You are NOT authorized to issue a chargeback for any reason.

Purposefully issuing a chargeback without contacting me to cancel/refund a project will result in immediate blacklisting for you as well as your email address, including side accounts.
